BACKGROUND: In May 2016, the Department of Labor (DOL) announced its long-awaited rule expanding overtime protection for employees. Starting Dec. 1, 2016, millions of employees will be eligible for overtime pay instead of being considered exempt from federal wage and hour laws, often even if they have managerial duties or otherwise used to qualify as exempt. These changes to the Fair Labor Standards Act (FLSA) will impact thousands of employers as they determine how to meet the new regulations while maintaining budgets and sustaining production.
